Investigations in the Educational Sector

The Educational Sector as a business encounters many of the same difficulties faced by the general commercial sector. The main difference being the Education Sector have the child’s welfare as one of their core responsibilities.

Whilst not necessarily an initial consideration, lawful investigations can gather evidence to put the organisation in a strong and legal position to deal proactively with issues that arise.

Educational issues which require investigation are:

Why might a school have a need to contact Expert Investigations?

There are many reasons a school may need the expertise of Expert Investigations. They have the ability to take an investigation to a level we do not have the skills or expertise to do. They are particularly useful if you require computers to be interrogated after you have identified possible inappropriate use. This can be in terms of website access or excessive use within the working day. Another area is with the surveillance of staff who are off sick and you suspect they may be undertaking alternative employment or carrying out tasks they state they are unable to do.

At what stage would you get EI involved in an investigation?

As soon as you have carried out your fact finding/information gathering and you feel that the case will come under the Disciplinary procedure.  The sooner you have the in depth report from EI the stronger your evidence base will be.

Can you highlight a case?

We used EI for surveillance when we thought employees were undertaking paid employment whilst suspended which contravened the conditions of that neutral act

To us the two key things are the legal compliance and the independence to conduct the surveillance in order to gather the required evidence.

At what stage would you get EI involved in an investigation?

At the point that there is no explanation, suspicion of wrong doing and difficult to prove without an impartial investigation, and to assist in the decision making process in order to take a matter forward.
